Terms of Service

1. Scope of Application

These Terms of Service (hereinafter "Terms") apply to all contracts between:

and the user of the services – hereinafter referred to as "User" or "you" – regarding the use of the ID.de platform (hereinafter "Platform" or "Service").

By registering for a user account, you accept these Terms.

2. Description of Services

2.1 Core Services

itemID is a platform that connects physical items with digital identities. The Service includes:

  • Creation and management of digital item profiles ("IDs")
  • Generation of QR codes for item identification
  • Anonymous communication between finders and owners
  • Management of pet profiles (itemID | Pets)
  • Management of emergency ID cards (itemID | Emergency)

2.2 Free and Paid Services

Basic use of itemID is free and includes up to 3 IDs. Extended features and additional IDs can be unlocked through paid subscriptions or one-time purchases. Current prices are displayed on the Platform.

2.3 Availability

We strive to maintain high availability of the Service but cannot guarantee uninterrupted access. Maintenance work and technical issues may lead to temporary limitations.

3. Registration and User Account

3.1 Requirements

To register, you must:

  • be at least 16 years old, or
  • have the consent of a legal guardian

3.2 Account Information

You are required to provide truthful information during registration and to keep your login credentials confidential. Sharing your account with third parties is not permitted.

3.3 Account Security

You are responsible for all activities that occur under your account. If you suspect unauthorized use, please contact us immediately at hallo@itemid.de.

4. Usage Rights and Obligations

4.1 Permitted Use

You may only use the Platform for its intended purposes:

  • Registration and management of your personal items
  • Communication with finders of lost items
  • Management of pet and emergency information

4.2 Prohibited Use

The following actions are prohibited:

  • Registration of items that do not belong to you
  • Distribution of illegal, offensive, or misleading content
  • Manipulation or disruption of the Platform
  • Automated access (bots, scrapers) without permission
  • Commercial use without authorization
  • Sharing QR codes to deceive third parties

4.3 User Content

You retain all rights to content (texts, images) that you upload to the Platform. By uploading, you grant us a non-exclusive, worldwide right to store, display, and process this content as part of the Service.

5. Special Provisions for itemID | Emergency (Emergency ID Cards)

5.1 Usage Notice

itemID | Emergency is not a medical product. Emergency ID cards are intended solely for voluntarily providing information to first responders and medical personnel. They do not replace official emergency identification, living wills, or medical documentation.

5.2 No Guarantee

We do not guarantee that:

  • stored information will actually be accessed in an emergency
  • first responders or medical personnel will consider the information
  • the Platform will be available during an emergency

5.3 User Responsibility

You are responsible for ensuring that stored medical information is current and accurate. Regular review and updates are recommended.

6. Special Provisions for itemID | Pets

6.1 Use for Pets

The Service enables the registration of pets and quick contact in case of a lost animal. The Service does not replace official registration or microchipping.

6.2 Responsibility

The accuracy of stored pet information is your responsibility. itemID assumes no liability for incorrect or outdated information.

7. Licensed Products (Merchandise)

7.1 Description

Through the Platform, you may purchase or register merchandise products with integrated QR codes ("Licensed Products") from partners. Registration is done using a PIN.

7.2 Ownership Transfer

Licensed Products can be transferred to other users. Transfer history is recorded.

7.3 Content Rights

Content linked to licensed products (e.g., videos, images, certificates of authenticity) is subject to the rights of the respective licensor. Sharing or reproduction is only permitted with authorization.

8. Payment Terms

8.1 Prices

All prices include applicable VAT. Current prices are displayed on the Platform.

8.2 Payment Methods

Available payment methods are shown during the checkout process. Payment is processed through secure payment service providers.

8.3 Subscriptions

Paid subscriptions automatically renew for the selected period unless cancelled before expiration. Cancellation is possible at any time effective at the end of the current period.

9. Right of Withdrawal

9.1 Withdrawal Information

As a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of contract conclusion.

To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement (e.g., email):

9.2 Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you no later than fourteen days from the day on which we received notification of your withdrawal.

9.3 Exceptions

The right of withdrawal expires prematurely if we have begun to perform the service after you have given your express consent and acknowledged that you will lose your right of withdrawal once the contract has been fully performed.

10. Liability

10.1 Limitation of Liability

We are fully liable for intent and gross negligence as well as for damages resulting from injury to life, body, or health. Otherwise, we are only liable for breach of essential contractual obligations (cardinal obligations), whereby liability is limited to foreseeable, contract-typical damages.

10.2 Use at Own Risk

Use of the Platform is at your own risk. We assume no liability for:

  • Damages caused by incorrect or incomplete user inputs
  • Data loss due to technical failures
  • Actions of third parties (e.g., unauthorized access through shared credentials)
  • Failure to locate lost items
  • Damages in connection with the use of emergency ID cards

10.3 Liability for Links

We assume no liability for external links. The operators of linked pages are solely responsible for their content.

11. Data Protection

The collection and processing of your personal data is carried out in accordance with our Privacy Policy. By using our services, you consent to the processing of your data for the purposes described therein.

12. Term and Termination

12.1 Term

The user agreement is concluded for an indefinite period and can be terminated by either party at any time.

12.2 Termination by User

You can terminate your account at any time through account settings or by email to hallo@itemid.de. After termination, your data will be deleted in accordance with our Privacy Policy.

12.3 Termination by Provider

We reserve the right to suspend or delete user accounts in case of violation of these Terms. For serious violations, termination may be immediate.

12.4 Consequences of Termination

Upon termination of the contract, your IDs will be deactivated and QR codes will lead to a general information page.

13. Changes to Terms

We reserve the right to modify these Terms. You will be notified of significant changes by email. The modified terms shall be deemed accepted if you do not object within four weeks of receiving the notification. We will specifically draw your attention to this consequence in the notification.

14. Final Provisions

14.1 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

14.2 Jurisdiction

For disputes with entrepreneurs, the place of jurisdiction is Bad Kreuznach. For consumers, the statutory place of jurisdiction applies.

14.3 Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14.4 Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
